Terms of Service

1. Acceptance of Terms

By accessing or using the PersonaBlocks platform ("Service"), operated by Persona Blocks LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PersonaBlocks provides a sovereign identity verification platform that enables users to create blockchain-backed Verifiable Identity Certificates (VICs). The Service is currently in public beta on the Polygon Amoy testnet.

Beta Disclaimer: The Service is provided as a public beta for testing and evaluation purposes. Features, availability, and functionality may change without notice.

3. Eligibility

You must be at least 18 years old and capable of forming a binding legal agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. User Accounts and Wallets

Access to the Service requires an Ethereum-compatible wallet. You are solely responsible for:

Maintaining the security of your wallet and private keys
All activities that occur through your wallet connection
Any loss of access to your encrypted data resulting from lost wallet credentials

We do not have access to your wallet private keys and cannot recover lost credentials.

5. Identity Verification Data

When you use the verification service, you consent to the collection and processing of:

Government-issued identification documents
Biometric data (facial images, 3D facial models, liveness detection data)
Personal information extracted from identity documents

All identity data is encrypted using keys derived from your wallet signature. The Company does not retain unencrypted copies of your identity data after the initial verification process is complete.

6. Data Storage and Encryption

Your verified identity data is encrypted client-side and stored on the InterPlanetary File System (IPFS). Document references are recorded on the Polygon blockchain. You retain sole control over decryption access through your wallet.

7. Merchant Access

You may grant time-limited access to your verified identity data to registered merchants. You can revoke merchant access at any time. The Company maintains audit logs of all access events for compliance purposes.

8. Prohibited Uses

You agree not to:

Submit fraudulent, stolen, or forged identity documents
Attempt to impersonate another individual
Circumvent or attempt to circumvent the liveness detection system
Use the Service for money laundering, terrorist financing, or any illegal purpose
Interfere with or disrupt the Service or its infrastructure
Reverse engineer, decompile, or attempt to extract source code from the Service

9. Compliance and Regulatory

The Service incorporates sanctions screening, anti-money laundering (AML), and suspicious activity reporting (SAR) capabilities. The Company may be required to report certain activities to regulatory authorities including FinCEN, OFAC, or equivalent bodies.

10. Intellectual Property

The Service, including its software, algorithms (including the Meredith Marks watermarking system), user interface, and documentation, is the intellectual property of Persona Blocks LLC. Your use of the Service does not grant you any rights to our intellectual property beyond the limited license to use the Service as intended.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF ACCESS TO ENCRYPTED DOCUMENTS, OR BLOCKCHAIN TRANSACTION FAILURES.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis during the beta period without warranties of any kind, either express or implied.

12. Indemnification

You agree to indemnify and hold harmless Persona Blocks LLC, its officers, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service. Continued use after modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Cobb County, Georgia.
